EducompOnline EduOlympiad (hereinafter referred to as EduOlympiad) is being conducted by EducompOnline Supplemental Service Ltd. (hereinafter referred as Educomp).

Educomp reserves the right to change the terms, conditions, and notices under which the EduOlympiad is conducted, including but not limited to the charges, prizes associated with the EduOlympiad. Participants & users are advised to regularly review the terms and conditions.

Participation in EduOlympiad shall be construed as an acceptance of these terms and conditions by the Participant as well as his/her guardian. Any breach or default by a Participant or of his/her guardian of any of these terms and conditions shall result in immediate disqualification without any notice.

Any incomplete or incorrect information provided is liable to make the participant’s candidature rejected and thus not be eligible for any gifts, prizes or scholarships or reimbursements. Educomp shall be authorized to determine the same at its own discretion.

Educomp is not responsible for the participant's inability to complete or continue an online/mobile based or physical test due to computer malfunction, internet failure, other technical disruptions, and other natural and man-made acts. Under none of these circumstances or otherwise, will the participation fees be refunded.

The candidature of a participant will stand cancelled and the participation fees be forfeited in case a participant fails to complete the test and/or the registration within the stipulated dates communicated. Educomp will ensure that regular and extensive communication is sent to the participants before canceling of candidature and forfeiture of participation fees, through SMS on the registered mobile number.

Educomp reserves the right to withdraw or discontinue EduOlympiad at any stage due to Force Majeure conditions or otherwise and Educomp shall bear no responsibility for cancellation or postponement of the EduOlympiad. Further Educomp shall not be responsible or liable for any cost, loss or damages suffered by the winner or a participant and their parents or guardians on account of discontinuation or changes in dates or schedule of the event.

Under no circumstances shall Educomp be held responsible for psychological satisfaction of the winners or on account of force majeure events mentioned above or for reasons beyond Educomp’s control.

FEES

The one time registration fee for participation in EduOlympiad is Rs.100 per student per subject.
The fees charged for participation in EduOlympiad shall not be refundable under any circumstances.

ELIGIBILITY

All school students studying in classes 4th to class 12th are eligible to participate in the EduOlympiad subject to their age being more than or equal to 6 years and less than or equal to 20 years as on 1st Dec, 2011.

Anybody, who does participate in EduOlympiad without fulfilling these eligibility criteria, to the satisfaction of Educomp, will not be entitled to any prizes, scholarships, rewards and could be disqualified at any stage. The fees paid by these students will under no circumstances be refunded.

To be eligible to participate in EduOlympiad, participant must be an Indian national or resident of India residing in India.

Apart from these, every participant or participant’s parent/guardian should have a mobile number that they will input during the registration process, which will be the medium for all communication from Educomp to the participant for the purposes of EduOlympiad. Educomp takes no liability for non-delivery of communication or technical issues arising during testing over IVR due to the network problems at the telecom service provider’s end or due to an existing or new policy from the government’s side. The participants are advised to use a mobile number which is accessible to them for speedy delivery of any communication.

Please refrain from using incorrect data while registering and later stages. All the data filled will be verified at the time of the on-the-ground stage through checking of documents (government identification proofs, student identification cards or documents issued from the student’s school or an affidavit from the school mentioning the student’s details on record) and/or at the discretion of Educomp, during the earlier rounds also.

PRIZES

Educomp shall take all necessary steps to ensure the delivery of prizes and gifts for the winners. However, in case the same are not delivered due to circumstances and situations outside of Educomp’s control and the winners also fail to collect the same from Educomp within 1 month of the end of all the the levels, Educomp reserves the right to not entertain any further requests for the delivery of the said prizes & gifts and shall not in any manner be responsible for any such non-entertainment of requests.

Educomp at its sole discretion, reserves the right: (i) to decide whether a replacement winner should be selected in the event any winner forfeits his/her claim to the prize; (ii) to disqualify any Participant for providing misleading or false information; (iii) to disqualify any Participant if it has reasonable grounds to believe the Participant has breached the terms and conditions of the EduOlympiad; (iv) to disqualify any Participant for acting in a disruptive manner; or acting with the intent to annoy, abuse, threaten or harass any individual. Educomp reserves the right to seek damages from any such Participant to the extent permitted by law.

The cash prizes shall be subject to tax deduction at source, which will be borne by the winners. All taxes, insurances, transfers, and other incidental and related expenses as the case may be, unless specifically stated, shall be the sole responsibility of the winner. The winner will be required to provide certified proof of identity, residence, Date of birth etc. as and when requested by Educomp to claim their prizes.

Educomp shall neither be responsible nor liable for any cost, expense or other liability whatsoever (including but not limited to any loss or damage) in relation to, arising from or connected with prizes or the whole event.

The prizes are non-transferable and not exchangeable. No other person or agent can claim the prizes on behalf of the winner unless specifically approved by Educomp in writing. Apart from the prizes, the winners or their legal heirs will have no other rights or claims against Educomp.

In case of a tie, Educomp reserves the right to decide the final winners and/or redistribute the prize money.

TRAVEL

All costs & arrangements of travel, boarding and lodging of the participant & their guardian or accomplice shall be borne by the participant and their guardians for all the rounds, prize distribution and/or any other event connected with the EduOlympiad. For the set of winners who fail to attend a prize distribution ceremony (if any), the prizes and/or gifts shall be sent to their address provided and as available with Educomp from the previous stages.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, all names, designs, logos, titles, text, images, audio, video, software, data or other content contained in the Events are protected by copyright and other intellectual property rights belonging to Educomp, its affiliates, partners and agencies and all such rights are hereby asserted and reserved.

Participants & other participants & users may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the content and questions used for the purpose of the EduOlympiad.

The entire content in the website, including but not limited to text, design, graphics, interfaces, or code and the selection and arrangements thereof is an intellectual property of Educomp.

PARTICIPANT & USER BEHAVIOUR

Participants & users agree not to indulge in any activity which is in bad taste on the platforms maintained & provided for EduOlympiad, including but not limited to using obscene or abusive language, impersonation or bad mouthing of any Educomp employee, its partners and agencies employees, hosts, or representative or other members or visitors on the site.

In the larger interest participants agree not to share any question or testing material from the EduOlympiad whether verbally, through written or electronic communication. In case such a deviation is detected, the candidature of the participant will be immediately terminated and all the prizes and fees forfeited. Participants & users also agree to share any information on any participant indulging in this kind of practice, with the proper authorities at Educomp at the earliest possible.

The participants also agree to participate in the true spirit of competition and refrain from using any unfair means or support during their testing. In case Educomp finds out about any participant using unfair means during or after the testing, the candidature of the participant will be immediately terminated and all the prizes and fees forfeited.

WARRANTIES & INDEMNIFICATION

Participants shall indemnify, defend and hold harmless Educomp (including its and their officers, directors, employees, affiliates, group companies, agents, representatives or subcontractors) from any and all claims and losses imposed on, incurred by or asserted as a result of or related to:
(i) The participant’s registration & participation & use of EduOlympiad
(ii) Any non-compliance by the participant with the terms and conditions mentioned herewith
Educomp services are provided without warranties of any kind, express, statutory or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability of fitness for a particular purpose. No advice or information given by Educomp, its affiliates or their respective employees shall create a warranty. Neither Educomp nor its affiliates warrant that the Educomp services will not be interrupted or error free or that any information, software or other material accessible on the telecom services or through the internet are free of viruses, worms, trojan horses or other harmful components. Educomp shall solely at its own cost ensure that its equipment is adequately protected and Educomp accepts no responsibilities or liabilities of any kind for loss of any data files.

In no event shall Educomp be liable to any other person/party for direct or indirect consequential loss or damage, economic or otherwise, including of profits and loss of reputation, goodwill, even if advised of the possibility thereof.

While Educomp along with its partners, agencies and vendors will take all necessary steps to ensure that EduOlympiad is conducted in an error free manner without any technical glitches, in the eventuality of such a case, Educomp and the said partners, agencies & vendors will not be liable for any compensation or discounts to the participants & users, whether financial or non-financial.

While Educomp shall try by all means to avoid any factual errors in the questions served or content shared with the participants, Educomp makes no representations or warranties that EduOlympiad questions and/or content will be 100% error-free. In case of a question being factually wrong, necessary steps will be taken by Educomp to ensure that it does not affect the macro results and no participant is at a disadvantage whatsoever. In no event will Educomp or any of its directors, officers, employees, representatives, affiliates, or agents be liable to any party for any punitive, consequential, direct, incidental, indirect, special, exemplary, or similar damages even if advised of the possibility of such damage.

Educomp reserves the right to defer or cancel any part of EduOlympiad at its discretion without assigning any reason thereof. It will however take all steps necessary to minimize the inconvenience caused to participants & users.

Educomp shall have no liability whatsoever, for loss or damage to any property or person which may be alleged to have arisen from or in relation with the participation in EduOlympiad and by any participant. Educomp will not be liable for any indirect or consequential loss suffered by participant, user or any other party; or any loss of profits or loss of business (direct or indirect) suffered by any user or organization

Educomp and the authorized people thereon reserve the right to refuse any person who in their judgment is found to be unmanageable or a danger to the safety or enjoyment of others. In this event neither refund of fees nor any applicable reimbursements will be given to the bereaved party under any circumstances.

Any photographs, videos, or other recorded media for EduOlympiad may be used by Educomp for the purposes of marketing or advertising without any payment or compensation being offered and without any request being made to any parties

The information collected from the participants & users will be used for promotional and other purposes by Educomp and its partners as per Educomp’s discretion. The information will however not be sold to a third party under any circumstances.

Educomp makes no warranties or representations about the accuracy or completeness of this website's content or of the content used in various channels for the execution or promotion of EduOlympiad.

Educomp does not filter advertisements or other content that children may view through our sites or linked sites or web links and takes no responsibility on its content. Educomp encourages & advises parents and guardians to consider using an electronic filtering software.

These terms and conditions are governed in accordance with the laws of India. Any dispute shall be subject to the exclusive jurisdiction of courts in Delhi only.
